HC stays govt order declaring auto components manufacturing
The Madras High Court Thursday stayed a recent government order declaring the Auto Components Manufacturing Industry as 'public utility service' (PUS).
Granting the interim stay, Justice V Parthiban said the GO suffers from "arbitrariness and non-application of mind."
"..this court is prima facie satisfied that the government order declaring the auto components manufacturing Industry as public utility service does not satisfy the requirement as provided under section 2(n) of the Industrial disputes act 1947.
This court is also satisfied that there is no public emergency or public interest involved in the auto components manufacturing industry..."
The matter relates to a petition from 'Kovai Mavatta Pricol Thozhilalar Otrumai Sangam', aN union affiliated to All India Central Council of Trade Unions (AICCTU) which is a Central government recognized trade union centre.
It is functioning in Pricol Limited, an auto component major, which is in existence more than 35 years.
