Memphis Smith demanded that Moknii Hamza sign a prenup on 90 Day Fiancé: Before The 90 Days, but it appears that she might not exactly understand how prenups work. Before Memphis flew to Tunisia, she and Hamza communicated for about eight months. While Memphis was in America and they still hadn’t met in person, Hamza proposed to the single mother of two. She accepted and left the US not only to meet him but also to get married to someone she thinks is the love of her life. Alas, their time together has been full of turmoil.
First Hamza’s mother Hayet found them in bed together after she said it was inappropriate. Hamza’s sister, Rawia, then revealed that Hamza's actually two years younger than Memphis thought, bringing their age gap to eight years. On top of that, Memphis finally revealed her biggest secret about staying with her ex-husband for a few days while she worked on her mental health, and Hamza believed there were still feelings between them two. Now, it’s several days before the wedding, and Memphis has contacted a lawyer for the prenup. However, many fans are wondering if she’s aware of how prenups really work.
The first hurdle was getting Hamza to agree to a prenup. It took some work, but he finally agreed to sign it. Then, Memphis contacted a lawyer in the US to request a prenup. Unfortunately, the lawyer revealed information that made her second-guess her decision about getting married on the trip. According to the lawyer, Hamza needs adequate time to review the prenup before signing it. It’s crucial that 90 Day Fiancé star Hamza understands the prenup. Otherwise, it could potentially be thrown out in court. She would need a lot more time than a couple of days to translate the contract, have Hamza review, and sign it.
In fact, many fans have pointed out flaws in Memphis’s plan. For example, a Reddit user wrote, “Her ‘thinking about building a house’ isn’t included if they’re already married. I don’t think she realizes that.” Moreover, the plan to give Hamza nothing also infuriates viewers. Another Reddit fan said, “It’s 100 percent a trap. Plan to marry him 2 weeks after meeting AND make him sign a prenup, so he has nothing without her in America. She might as well have gone over there to kidnap him.” Typically, prenups are for assets that the couples already had before marriage, but it appears that Memphis is also trying to include future assets. Many viewers believe this is another example of how Memphis is rushing to get married on 90 Day Fiancé but cannot relinquish control.
While it’s understandable that Memphis would want to protect herself and her children, it appears that she is unwilling to share anything with Hamza, despite the sacrifices he’s making. At the end of the episode, she spent the evening at a hotel reviewing her options. Even though there’s not enough time for a prenup, she is considering a postnup. However, that creates more risk, as there’s no guarantee Hamza will sign it after marriage. It’s been clear all along that Memphis is in a rush to marry Hamza, and the prenup situation might alter that. In the end, there are still a few episodes left in the season and viewers are anxiously waiting to see if Memphis and Hamza tie the knot on future episodes of 90 Day Fiancé: Before The 90 Days.
