The court said that the suit was not either barred by the Waqf Act of 1995 or the UP Shri Kashi Vishwanath Temple Act of 1983. The 1991 Act prohibits change in religious character of any place of worship as it existed on August 15, 1947, which was central to the mosque committee's argument.
