Ed Sheeran Must Face a Jury Trial Over 'Thinking Out Loud' Marvin Gaye Copyright Case

Ed Sheeran is heading to court.

A federal judge said the 31-year-old singer-songwriter must face a jury trial over whether he stole key parts of his hit single “Thinking Out Loud” from Marvin Gaye‘s iconic 1973 song “Let’s Get It On,” thereby rejecting his attempts to toss out the case, via Billboard.

Ed’s lawyers argue that the lawsuit, filed by an entity that owns a partial stake in the song, was invalid because the combination of simple elements he allegedly stole was not unique enough to be covered by a copyright in the first place.

However, Judge Louis Stanton ruled there was “no bright-line rule” for deciding that, and that Ed must argue his case in front of a jury on trial at a Manhattan federal courthouse at some point in the future.

A date has not yet been set.

He recently defeated a similar lawsuit in the U.K. that claimed he stole to create his 2017 hit, “Shape of You.”
