Kodak Black to be freed from jail after Miami judge grants him time served on probation violation

South Florida rapper Kodak Black is free from jail after a Miami judge sentenced him to time served on Wednesday, the last in a series of legal barriers that had kept him locked up in two counties.

The rapper should now be able to witness the birth of his son on Friday.

Black, whose legal name is Bill Kapri, was placed in a federal detention center in Miami following his arrest in Plantation in December in which he was charged with possession of cocaine, later changed to oxycodone, and tampering with evidence.

The oxycodone possession charge was later dismissed. But the arrest violated Black’s probation in a federal gun-purchasing case, so a Miami federal judge revoked his bond. Meanwhile, a Broward judge revoked Black’s bond in a third case from 2022 in which he was charged with trafficking in oxycodone.

On Friday, Judge Barbara Duffy reinstated a $250,000 bond for the trafficking case, and set a $5,000 bond in the December case. Black’s attorney, Bradford Cohen, had argued that the rapper had a baby due on Friday, Feb. 23, and ought to be free to witness his birth.

Then, on Wednesday, Judge Jose E. Martinez released Black with credit for time served, the last measure needed to free him, after Black “freely and voluntarily admitted” to one violation of his probation.

The violation was failing to report police contact, Cohen said. All of the other violations were dismissed.

Cohen expects the rapper to be released within hours, by Wednesday evening.

“I’m very happy it was resolved,” Cohen told the South Florida Sun Sentinel. “I think the State Attorney of Broward County needs to focus on crimes that are actual crimes as opposed to individuals that have prescriptions for medication.”
