Former NYS employee sentenced for unemployment insurance fraud scheme

ALBANY, N.Y. (NEWS10) -- The U.S. Attorney's Office announced the sentencing of Carl DiVeglia III, 36, of Albany, to one year and eight months in prison. DiVeglia previously pleaded guilty to conspiring to commit mail fraud.

As part of his plea, DiVeglia confessed to taking advantage of his state computer access while working for the New York State Department of Labor by creating and approving false unemployment insurance applications between 2020 and 2021. His actions resulted in the Department of Labor taking over $1.6 million in losses, and with DiVeglia fraudulently receiving about $225,000.

Two of DiVeglia's co-conspirators, Wendell Giles, and Rocco "Rock" Resciniti, have also been sentenced for their roles in the scheme. Three other defendants, Jamaine Myers, Todd "Fats" Ward, and Christopher "Reek" Ward, have all pleaded guilty in the case.

In addition to prison time, DiVeglia must serve a two-year term of post-release supervision. He was also ordered to pay $1,662,819 in restitution to New York State and to forfeit the $225,000 he acquired to the federal government.
