The full-back, who now plays in France, was led from a custody van in cuffs by guards into the court.
It’s understood police arrested him again on Monday for an alleged stalking offence and breaching strict bail conditions not to contact his estranged wife, Gillian.
Hogg has already pleaded guilty to breaching the strict court orders and was due to be sentenced for that today.
But his lawyer Matt Patrick told the court that there was nothing in his conduct that was “violent”.
He said: “There is nothing in the new allegations that allege violence or any threats of violence.
“In the statement I have seen today the complainer explicitly states that.
“These breaches have arisen as a result of Mr Hogg contacting the complainer via Facetime to speak to his kids.”
Despite prosecutors objecting to Hogg being released Sheriff Peter Paterson allowed him to walk free from court.
The law chief said: “I will grant bail but you must not contact the complainer, or enter the street in Hawick where she resides.
“If you see her you must not say anything to her, contact her by electronic means or speak about her to anyone.”
This is the third time Hogg has been arrested. He was previously nicked in February and July.
When Hogg appeared in the dock in July Sheriff Kevin McCarron told him that if he breached any of the court orders it would “highly unlikely” that he would remain at liberty.
In May, he appeared in the dock where he denied abusing and stalking his estranged wife Gillian, 37, over a seven-year period.
Hogg is accused of monitoring her communications and controlling her family life.
He is also charged under section one of the Domestic Abuse Scotland Act.
Hogg allegedly engaged in a course of behaviour which was “abusive”.
Confirming his latest arrest a spokesperson for Police Scotland said: “A 32-year-old man has been arrested and charged in connection with stalking offences and breach of bail conditions.
“He is due to appear before Jedburgh Sheriff Court on Tuesday, 10 September, 2024, and a report will be submitted to the Procurator Fiscal.”
