Homeowners file lawsuit against Lake Oswego after city orders them to destroy too tall roof

PORTLAND, Ore. (KOIN) -- The City of Lake Oswego is telling a pair of homeowners to tear down their roof because it's 10 inches too tall, and now the homeowners are taking the city to court.

Shane and Kelly Hubbell submitted plans for their home with a height of 30 feet, 10-and-one-fourth inches, which they claim the city approved, according to court documents, which were first reported by The Oregonian/OregonLive. However, the building code in the area limits roof heights to 30 feet.

Documents say that 90 days after the approval, the city's senior development planner notified the Hubbells that it was wrongly approved.

The couple is now seeking more than $150,000 in damages from Lake Oswego for structure changes.
