Petition “Turn back the time“: court made the decision
Tengrinews.kz - The Specialized Interdistrict Administrative Court in Astana issued a decision on the lawsuit challenging the legality of the results of the petition review regarding the clock change in Kazakhstan.
According to the court, the results of the petition review titled "Turn back time" were deemed lawful.
After reviewing the case materials, the court established the following. In accordance with the requirements of the Administrative Procedural and Process-Related Code (APPC), the petition "Turn back time" was registered. The petition garnered 50,000 supporting votes and was officially registered. The Ministry of Trade and Integration was tasked with reviewing the petition.
"The Ministry sent letters to the petitioner, the parliament, relevant government agencies, and public organizations, requesting nominees for the working group. On June 14, 2024, the Mazhilis proposed the candidacies of Erkin Abil. and Murat Abenov. On June 21, 2024, the minister approved the composition of the working group, appointing Erkin Abil as deputy leader. The working group held three meetings: on June 21, July 16, and August 2, 2024.
It is reported that on August 2, a decision was made to reject the petition. The registration and processing of petitions are carried out in accordance with the procedure established by the authorized body for the interaction between the state and civil society," the court's statement reads.
According to Article 90-6 of APPC, following the review of the petition, the first head of a central state or local executive body, or the chairperson of a local representative body, shall make one of the following decisions:
to fully or partially satisfy the petition;
to deny the petition.
It is noted that the procedure for reviewing the petition and making a decision on it is regulated by the norms of the APPC.
When reviewing lawsuits challenging the decision made on a petition, the court only evaluates compliance with the procedure and deadlines for reviewing the petition.
"The court denied the lawsuit due to the absence of procedural violations. The plaintiff's arguments about the chairmanship of Mazhilis deputy Erkin Abil was rejected, as he was the deputy head of the working group. No violations were found in the formation of the commission, and the court deemed the decisions and actions lawful and within the competence of the state authority," the statement reads.
The decision has not yet come into legal force.
