Busuttil 's driver says elements for magisterial inquiry do not exist
Anthony Tabone, the driver of Opposition leader Simon Busuttil, has filed an application in court calling for a magisterial inquiry about the fuel consumption of Dr Busuttil's car to be quashed because the elements for it to be called did not exist.
Mr Tabone said he had been told about the inquiry by Dr Busuttil but to date he still did not know on what basis the inquiry had been called.
He noted, however, that the Speaker of the House of Representatives, Anglu Farrugia had denied that he made an application to be police. He had also said that no report on fraud had been made and that he (Mr Tabone) should not be suspended any longer since no direct evidence against him existed.
Mr Tabone observed that in terms of the law, a magisterial inquiry could only be called if there was a report to the police or an application and when such reports involved a crime punishable by more than three years imprisonment.
These elements did not exist and the inquiry should therefore be quashed, Mr Tabone said.
