The Supreme Court has mandated that police cannot issue pre-arrest notices via WhatsApp or other electronic means under Section 41A of the CrPC or Section 35 of the BNSS. Notices must be served through prescribed modes only. The court also considered aiding poor undertrial prisoners with verified Aadhaar cards for bail.
