Cleveland County ex-pastor arrested for third time in three months
CLEVELAND COUNTY, Okla. (KFOR) – The Cleveland County District Attorney's office has charged a former pastor who's accused of sending an unsolicited nude photo of himself to a Kansas teenager.
News 4 spoke with the victim's father in December, who was relieved after hearing James McMillan had been arrested in connection to the case. News 4 isn't naming him to protect his daughter's identity and family's privacy.
“He’s clearly proven that he has a problem with this and won’t, you know, won’t stop,” said the victim’s father in December. “He’s somebody that’s truly a danger to our society.”
Court documents allege McMillan added the victim on Snapchat in 2023. The victim told police at the time McMillan would have had to use his son's phone, her former classmate, to look up er account by name due to privacy settings. The victim told authorities McMillan sent her an unprompted photo of himself working out and flexing in the mirror. Texts between the victim and another minor identified in the court documents say that the victim told the other minor she would wait and see if he said something inappropriate. If McMillan did say anything inappropriate, the teen said she would screenshot it and report it to the police. The second minor in the documents calls McMillan a pedophile.
After sending the workout photo, documents say McMillan responded something to the effect of "trying to get them gains." McMillan allegedly asked the victim if she wanted to see more before sending her an unsolicited nude photo of himself.
Documents say while searching McMillan's cellular device with a search warrant back in November of 2024, Oklahoma investigators found the unsolicited photo the teen victim had taken a screenshot of.
"It's very clear evidence as to what happened," the victim's father said in an interview with News 4 employees Thursday.
The warrant was executed in connection to a different set of allegations McMillan was arrested for in November, claiming he was sexually inappropriate with a different underaged child and exposed himself to them.
State investigators determined in December they had enough evidence to request a warrant for McMillan's second arrest on the Kansas case. McMillan was arrested, but ultimately released by Cleveland County District Attorney Greg Mashburn's office didn't file charges at the time.
"It was shocking," the victim's father said. "They should, in my mind, be a lot more willing to, you know, take the bull by the horns, so to speak, and and get the bad people off the street so they can't hurt anybody else."
News 4 reached out to a spokesperson for the DA's office at the time who shared the following statement:
McMillian's arrest on 12/9 was based on an OBN investigation involving acts committed in 2023. We requested further investigation from the agency regarding the warrant. At the conclusion of the investigation, there is a possibility of additional charges.

The victim's father said he waited patiently, fearing that McMillan might not be charged. Wednesday McMillan was formally charged with soliciting obscene pictures to a minor. News 4 read over the charge documents and found no additional information pertaining to the investigation that were made public record. The Kansas victim's father says he wasn't notified by the DA's office.
"I was not made aware of anything from the district attorney," the victim's father said. "It would have been nice to hear from them. Not just have to have to check the jail records to see if he's been arrested or not."
A News 4 employee reached out to a spokesperson for the DA's office again Thursday, questioning the length of the investigation when it came to filing the charge. News 4 received the following statement:
After further investigation was provided from the agency and a complete review of the charges, they were filed yesterday. He was taken into custody today.
