Trump demands dismissal after bank exec testifies in N.Y. fraud trial: report

Donald Trump’s lawyer tried again Tuesday to get the former president’s civil fraud case thrown out after a Deutsche Bank executive testified on his behalf, according to a new report.

Christopher Kise pleaded with a skeptical judge Arthur Engoron to dismiss the $250 million lawsuit on the basis that Trump’s biggest lender didn’t rely solely on Trump Organization financial records when issuing loans, according to the Messenger.

“This is a highly sophisticated international financial institution that undertook significant due-diligence,” argued Kise, according to the report. “The bank conducted its own due diligence.”

But Engoron reportedly replied, “The mere fact that the lenders were happy doesn’t mean the statute wasn’t violated.”

Kise’s plea came after Dave Williams — managing director of Deutsche Bank, Trump’s biggest lender in the 2010s — testified that, to his knowledge, the former president hadn’t violated his loan agreements, the Messenger reports.

Engoron has already found Trump liable for fraud in the case brought by New York Attorney General Letitia James, who contends the Trump Organization defrauded lenders by inflating its worth. Trump denies wrongdoing.

While Trump’s lawyers argued Williams’ testimony broke the case, State prosecutors said he only made it stronger, the report notes.

“The witness said that they expect their clients to tell the truth and not lie and not submit fraudulent statements,” State counsel Kevin Wallace reportedly said.

“I think the idea that you can’t lie to a bank has been pretty well established.”
