‘Is this the Christmas spirit?’ Judge jokes as Trump and AG agree to work together
Call it a civilmas miracle — attorneys for Donald Trump and the New York Attorney General’s office have agreed to collaborate on court evidence, according to a reporter covering the trial.
Trump’s attorney Cliff Robert and state attorney Kevin Wallace told Judge Arthur Engoron Wednesday that they’re going to try to agree on financial documents submitted as evidence to save a witness time on the stand, according to Law360 reporter Stewart Bishop.
“Is this the Christmas spirit or something?” Engoron reportedly quipped.
The witness in question was Patrick Birney, a Trump Organization vice president whom Bishop noted, in all caps, testified “at length” in the civil fraud trial.
Birney has said in court that he helped with the Trump Organization’s statements financial condition — key evidence in Attorney General Letitia James’ case — but had no understanding of necessary accounting standards and didn't contribute to final calculations, Bishop reports.

Trump’s defense team called Birney in to discuss the concept of a “presidential premium,” which posited that Trump Organization assets gained value with the increased status of its namesake, Bishop writes. He also fielded questions about inflated values.
“Were you ever directed to increase a number without there being a basis to support that increase?” Trump attorney Jennifer Hernandez reportedly asked.
“No,” Birney replied.
James contends the value of Trump Organization assets were fraudulently inflated to defraud investors and lenders. While Trump denies wrongdoing, Engoron has already ruled the former president is liable for fraud. The work of the trial is to assess damages.
Birney’s testimony concluded about 4:20 p.m. Wednesday, the 36th day of a trial slated to run through mid-December and into the holiday season.
